How to Get Pollution Certificates for Your Factory in Tamil Nadu

Starting a factory in Tamil Nadu — especially in a Red Zone industrial area — requires obtaining pollution consent from the Tamil Nadu Pollution Control Board (TNPCB). This process, while bureaucratic, is well-defined and manageable when you know the steps. This guide walks you through the full process.

The Two Key Consents: CTE and CTO

TNPCB issues two types of consent for industrial units:

• Consent to Establish (CTE): Required before you start constructing or setting up your factory. This approves your project design and pollution mitigation plan.
• Consent to Operate (CTO): Required before you commence commercial production. This confirms your installed pollution control measures are adequate.

Both must be obtained before the respective activities. Operating without CTE/CTO carries heavy penalties and can result in unit closure.

Step 1: Classify Your Industry

The fees, documents, and scrutiny level depend on your industry's pollution classification — Red, Orange, or Green. Red category industries receive the most detailed scrutiny and have the highest compliance requirements. Step 2: Prepare Your Project Report

The Environmental Project Report (EPR) must include:

• Nature and scale of operations
• Raw materials used and quantities
• Water consumption and source
• Effluent generation, characteristics, and treatment plan
• Air emissions, stack height, and control measures
• Solid waste generation and disposal method
• Noise levels and mitigation measures
• Site layout plan showing plant, effluent treatment (ETP), and green belt

Step 3: Submit CTE Application

Applications are submitted online via the TNPCB portal (ocmms.tnpcb.gov.in). Required documents include:

• Duly filled Form-I (for CTE)
• Environmental Project Report
• Site plan and factory layout
• Land document (sale deed, lease agreement, or patta)
• Land use approval from local body (DTCP/SIPCOT approval)
• NOC from local panchayat or municipality
• Prescribed fee (based on capital investment)

Step 4: Site Inspection by TNPCB

After application submission, TNPCB officers will conduct a site inspection to verify the site location, assess pollution potential, and review proposed control measures. Be prepared to explain your ETP plan and stack emission controls in detail during this inspection.

Step 5: CTE Approval and Construction

If TNPCB is satisfied, they issue the CTE. This is typically valid for 2–3 years, during which you must complete construction and install all pollution control systems as specified.

Step 6: Apply for CTO Before Production

Once your factory is built and pollution control equipment is installed, apply for CTO through the same TNPCB portal. This involves a fresh site inspection to verify that installed systems match the CTE-approved plan. Upon satisfaction, CTO is issued, typically valid for 1–5 years and renewable.

Typical Timeline

• CTE application to approval: 2–4 months for Red Zone industries
• Construction and ETP installation: 6–18 months (varies)
• CTO application to approval: 1–2 months
